MN Supreme Court Justice is a Norm Coleman Donor and Should Recuse Himself

Last week, I took a look at the political leanings of the five Minnesota Supreme Court Justices who will decide Republican Norm Coleman’s likely appeal.  Of one of the five Justices, Justice Christopher J. Dietzen, I suggested that he “has the clearest partisan background” of any of the Justices, pointing to facts including Dietzen serving as a campaign lawyer on Republican Gov. Tim Pawlenty’s 2002 campaign.  Of Dietzen’s service on Republican Pawlenty’s campaign, I sarcastically noted:

So, Republican Gov. Tim Pawlenty’s campaign lawyer is one of the five judges that will decide Republican Norm Coleman’s appeal.  Nothing wrong with that.

Clearly, one of the Justices being active in Republican politics is sketchy, but I didn’t go so far as to call for Justice Dietzen to recuse himself from any further cases before the state Supreme Court involving Norm Coleman and the Senate seat.  Until now.

DownWithTyranny! took my analysis a little further and found out that Justice Dietzen is himself a two-time Norm Coleman donor!  A simple search on OpenSecrets.org finds that Justice Dietzen has given to a number of Republican committees and candidates, including:

FYI, Larkin Hoffman is one of the law firms that Dietzen worked at before becoming a judge.

Remember that two of the Minnesota Supreme Court’s seven Justices recused themselves from hearing Coleman’s appeal to the state Supreme Court because they served on the state Canvassing Board.  Those two Justices wanted to avoid the conflict of having served on the Canvassing Board and then serving on the Court that will hear an appeal of, in part, the Canvassing Board’s actions and decisions.

Well, one of the remaining Justices that will decide Norm Coleman’s electoral fate is a two-time Norm Coleman donor!  Heck, one of the two contributions occurred in the six years leading up to Coleman’s 2008 re-election bid – in other words, it was put toward this very election whose result Coleman is preparing to appeal.  This is a crystal clear conflict of interest.  Justice Dietzen should recuse himself from any Coleman appeals to the state Supreme Court in order to prevent the (rather obvious) appearance of bias.  If you feel the same way, you should let Justice Dietzen know by contacting his office at (651) 297-7650, and – very respectfully – urging Justice Dietzen to recuse himself in order to avoid a clear conflict of interest and the appearance of bias by having a previous Norm Coleman donor rule on Norm Coleman’s electoral fate.

NC-Sen: Encourage AG Roy Cooper to Run for Senate

In a story released today by The News & Observer, North Carolina’s Democratic state Attorney General Roy Cooper indicated that he may decide on whether or not to run for Senate in 2010 IN THE NEXT FEW WEEKS!

Polls by Civitas and Public Policy Polling already show Attorney General Cooper beating Republican incumbent Richard Burr (who has recently gained notoriety by blocking Tammy Duckworth’s appointment to a Veterans Affairs post).

If you so see fit, PLEASE call Roy Cooper’s campaign office at 919-832-4312 (you’ll probably get voice mail) and leave a simple message encouraging Roy Cooper to run for Senate in 2010.  Explain that North Carolina and all of America would benefit by having his common sense voice replace Richard Burr’s obstructionist voice.

Every word of encouragement he receives makes him more likely to run — and, if he runs, we can replace Republican backbencher Richard Burr with a strong Democrat like Roy Cooper!

NY-20: Stick It to the GOP

While I typically focus on Senate races, the special election in New York’s 20th Congressional district is an excellent opportunity to stick it to the Republican Party.

NY-20 is a Republican leaning district in voter registration, but has been recently represented by now-Senator Kirsten Gillibrand and even narrowly supported now-President Barack Obama over John McCain.

The Democratic nominee, Scott Murphy, has turned a deficit in the polls into a narrow four-point lead over Republican Jim Tedisco.  Momentum is on our side!  A victory in this special election wouldn’t just be a nice Democratic hold, but, since it is a Republican-leaning district, it would also be a major embarrassment for Republicans, particularly new RNC Chair Michael Steele.

How desperate are Republicans in this race?  Well, they’re very literally reduced to going with a noun, a verb, and 9-11 in flailingly attacking Murphy.  And how loathsome is the Republican nominee?  Even the Libertarian candidate, who was booted from the race after – it would appear – Republicans made a concerted effort to get enough Libertarian ballot signatures overturned, has endorsed Scott Murphy.  (And it’s one hell of an endorsement.)

The special election is this Tuesday!  So what can you do to help?

This is a special election, so GOTV is everything.  On Monday or Tuesday, if you can spend literally one single hour making calls, that could be the difference in a Republican pick-up versus a Republican embarrassment.

One of the primary ways to Expand the Map of competitive U.S. Senate seats in 2008 is to empower with resources Democrats in states that Republicans hope to take for granted, so that they can focus on more traditionally battleground states.  Four such red states in 2008 are Mississippi, Kansas, Georgia, and Tennessee, where former Governor Ronnie Musgrove, former Congressman Jim Slattery, former state legislator Jim Martin, and former Tennessee Democratic Party Chair Bob Tuke are running to oust ethically questionable Roger Wicker, Bush-cover-up-artist Pat Roberts, Shameless Saxby Chambliss, and Lamar!, respectively.

OR-Sen: Senate Guru’s Twenty Twenties for Jeff Merkley

As I noted in my wrap-up of the OR-Sen Democratic primary, Speaker Jeff Merkley and the Democrats have the grassroots, the issues, and the momentum.  All Republican Gordon Smith has going for him is a campaign bankroll just shy of $5 million.

Smith is unquestionably vulnerable.  With enough resources, Merkley will be able to cut through Smith’s spin and deliver the facts of Smith’s record to the voters of Oregon.  But, of course, he’ll need the support of people throughout the grassroots and the netroots.

To that end, I have added Merkley to the Expand the Map! ActBlue page and am announcing the “Twenty Twenties for Jeff Merkley” effort.  Basically, I’m pleading with twenty of you to contribute at least twenty dollars via the Expand the Map! ActBlue page toward helping Jeff Merkley oust Gordon Smith.  Can twenty of you spare twenty bucks to bounce a bum like Republican Gordon Smith from the hallowed halls of the U.S. Senate?
