A Navy man’s wife who had an abortion after her fetus was diagnosed as brain-damaged with no hope of survival, must repay the government $3,000 because federal law bars funding of such abortions in the military, a federal appeals court ruled Thursday.
The law, which pays for abortions only if the woman’s life would be endangered by childbirth, does not violate the constitutional rights of military personnel or their spouses, said the Ninth U.S. Circuit Court of Appeals in San Francisco. The 3-0 ruling was sympathetic in its tone but certain in its conclusion.

What is the current law?
The current policy on abortions for military personnel and dependents is as follows:* Direct funding for abortions:
Banned, except for life of the mother situations (enacted as part of U.S. Code in 1984).
* Use of military facilities for abortions (paid for with private funds):
Banned, except for life of the mother, rape and incest situations (enacted as part of the U.S. Code in 1996) (This ban was also in place by DOD administrative directive from 1988-Jan. 1993.)
Some members have made attempts in recent years to attach pro-abortion amendments (such as the Davis Amendment) to defense and military appropriations bills.
