The New York Times reported last week that soft drink sales are down for the first time in 20 years, and sales of bottled water, juices and energy drinks are continuing to eat into the soda market.
Into this anti-carbonated climate comes a potentially bigger bombshell that could spell disaster for the industry. Last month, the FDA quietly revealed that some soft drinks were found to contain the human carcinogen benzene in levels up to 10-20 parts per billion (ppb) — four times the acceptable limit found in drinking water. Benzene, a chemical linked to leukemia and other forms of cancer, forms in certain beverages under certain conditions, such as exposure to heat and light.
Hmm…of course, the FDA has never determined an acceptable level for benzene in soda, so it must not really be a problem, right?

THE HAGUE, Netherlands (ABC/AP) 1 hour ago — A Dutch toxicologist said he found traces of an unprescribed antibiotic in Slobodan Milosevic’s system earlier this year after the former Yugoslav leader did not respond to blood pressure medication given at the U.N. detention center.
Donald Uges said he found traces of rifampicin, an antituberculosis drug that “makes the liver extremely active” and thus breaks down other medications very quickly, possibly taking away their effectiveness.
Milosevic, 64, had a history of heart problems and high blood pressure, and took medications to treat those conditions. He was found dead in his jail cell Saturday morning of an apparent heart attack.
There is speculation that he was taking the antibiotic to offset the blood pressure medication in order to “discredit medical care at a Dutch detention center and be allowed to seek treatment in Russia”.
Oopsie. Looks like maybe it worked a little too well.

Brinkema says U.S. prosecutors committed `egregious violation’
ALEXANDRIA, Va. – An angry federal judge unexpectedly recessed the death penalty trial of confessed al-Qaida conspirator Zacarias Moussaoui to consider whether government violations of her rules against coaching witnesses should remove the death penalty as an option.
The stunning development came at the opening of the fifth day of the trial as the government had informed the judge and the defense over the weekend that a lawyer for the Federal Aviation Administration had coached four government FAA witnesses in violation of the rule set by U.S. District Judge Leonie Brinkema. The rule was that no witness should hear trial testimony in advance.
“In all the years I’ve been on the bench, I’ve never seen such an egregious violation of the court’s rule on witnesses,” U.S. District Judge Leonie Brinkema said.
“This is the second significant error by the government affecting the constitutional rights of this defendant,” Brinkema said. “More importantly, it affects the integrity of the criminal justice system of the United States.”
I’ve been following this fairly closely, & Judge Brinkema really seems to have been fair in this difficult case, though I agree with Jeralynn (at Talk Left) that she should reconsider her ruling that he is mentally competent. (I’d add that the charges should never have been filed in the first place.)
Notably, she granted the defense access to those witnesses held as enemy combatants, who the gov’t wanted to keep out of the proceedings. They’ve largely won on appeal, but it’s not Brinkema’s fault.
Mentioned below, there’s more about the judge’s reaction Friday to some, umm, rather novel legal theories the gov’t is pushing in this case:

Hellerstein, U.S. District Judge for the Southern District of New York, allowed Mariani vs. United Airlines (UAL), et. al. to proceed immediately into discovery after granting a Justice Department motion for temporary stay, ending on September 20, Scoop Media reported Saturday.
A letter from Attorney General Ashcroft’s Justice Department (DOJ) office – leaked earlier to Scoop Media – had indicated that DOJ was attempting to intervene to control the access to evidence in Hellerstein’s courtroom, among other motions. The letter had revealed that Bush Administration officials at the Transportation and Security Administration (TSA) were in effect tampering with witnesses already subpoenaed by plaintiff attorneys, advising them to send evidence and documents to the TSA.
Have you read Mariani’s complaint? It’s the boldest of any I’ve seen. I haven’t read it in two years though. This case accuses Cheney of pulling off 9/11.
She, or someone in her circle got intimidated into letting that suit be merged into another one,…I think. There’s been so much to keep track of that details get lost. There were claims early on that her attorney might have deliberately built faults into it to fail, so, who knows?
This latest development in ZM’s trial has a lawyer from TSA contacting and coaching upcoming witnesses from FAA (at least, maybe others). Evidently she was wanting them to be very clear on prior claims that the FBI has made that they had sufficient knowledge of possible airline attacks when ZM was taken into custody.
It’s even possible that the lawyer did it to derail the trial to prevent damaging testimony for all of them from being revealed

George Ryan who has been accused of being a politician……is waiting to hear from the jury whether or not his stance on the death penalty,,,which was to commute the sentence of death row inmates and lead a nationwide movement to point out that DNA evidence overwhelming showed that death row inmates were not always guilty…he is waiting to hear whether he will spend perhpas the rest of his life in jail.
The much maligned governor was no crook, just a typical politician doing favors.
My sources told me he was indicted as punishment by Bush for banning Bush’s favorite pastime ….signing the death order for death row inmates.He wasn’t indicted by Patrick Fitzgerald, but Patrick Fitzgerald inherited the case and move it into high gear.
This trial is currently being conducted by everyone;s hero Patrick Fitzgerald who has seemingly done nothing in the Valerie Plame Scandal. I think Fitzgerald is honest, but he is extremely conservative, perhaps reactionary. Ryan is more liberal than most democrats.
In any case just reading the papers, it seems there is no evidence at all that George Ryan was a crook.
I predict the Jury will find him innocent.

I meant to say the case was not started by Fitzgerald that he inhertied it. He did indict Ryan, however.

Rana Abdel Rahim Koleilat, 39, who was sought by the international police agency Interpol, was arrested at a hotel in the city on Sunday afternoon by police acting on a tip.

The behavior of a massive ice sheet that existed in northern Europe at the end of the last Ice Age has been outlined for the first time, and researchers believe it may provide a sneak preview of how major ice sheets in Greenland and Antarctica will act in the face of global warming. The results probably mean that in the face of future global warming, the ice in large parts of Antarctica may actually increase, while the massive Greenland ice sheet — which exists in a slightly warmer setting — will almost certainly disappear. “This study supports what we’ve been learning about the Greenland ice sheet, which is that it will completely melt within 500 to 1,000 years,” said Peter Clark, a professor of geosciences at OSU and an international expert in the study of ancient ice sheets. “Our new analysis of the ancient Scandinavian Ice Sheet, like other studies, is showing how these events unfolded in the past, which will help us better understand what the future will hold.” If there is a net gain in ice in Antarctica, it will probably not be enough to offset the melting of the Greenland ice sheet.

I’ve been following this fairly closely, & Judge Brinkema really seems to have been fair in this difficult case, though I agree with Jeralynn (at Talk Left) that she should reconsider her ruling that he is mentally competent. (I’d add that the charges should never have been filed in the first place.)
Notably, she granted the defense access to those witnesses held as enemy combatants, who the gov’t wanted to keep out of the proceedings. They’ve largely won on appeal, but it’s not Brinkema’s fault.

She, or someone in her circle got intimidated into letting that suit be merged into another one,…I think. There’s been so much to keep track of that details get lost. There were claims early on that her attorney might have deliberately built faults into it to fail, so, who knows?
This latest development in ZM’s trial has a lawyer from TSA contacting and coaching upcoming witnesses from FAA (at least, maybe others). Evidently she was wanting them to be very clear on prior claims that the FBI has made that they had sufficient knowledge of possible airline attacks when ZM was taken into custody.
It’s even possible that the lawyer did it to derail the trial to prevent damaging testimony for all of them from being revealed
George Ryan who has been accused of being a politician……is waiting to hear from the jury whether or not his stance on the death penalty,,,which was to commute the sentence of death row inmates and lead a nationwide movement to point out that DNA evidence overwhelming showed that death row inmates were not always guilty…he is waiting to hear whether he will spend perhpas the rest of his life in jail.
The much maligned governor was no crook, just a typical politician doing favors.
My sources told me he was indicted as punishment by Bush for banning Bush’s favorite pastime ….signing the death order for death row inmates.He wasn’t indicted by Patrick Fitzgerald, but Patrick Fitzgerald inherited the case and move it into high gear.
This trial is currently being conducted by everyone;s hero Patrick Fitzgerald who has seemingly done nothing in the Valerie Plame Scandal. I think Fitzgerald is honest, but he is extremely conservative, perhaps reactionary. Ryan is more liberal than most democrats.
In any case just reading the papers, it seems there is no evidence at all that George Ryan was a crook.
I predict the Jury will find him innocent.
I meant to say the case was not started by Fitzgerald that he inhertied it. He did indict Ryan, however.

It really sounds like the judge is on the verge of tossing the death penalty off the table. Should she do so, Bush loses his show trial since this is penalty phase only; he’s already pleaded guilty to the charges the DoJ drew up.

Didn’t know if you all had seen the video of Cindy Sheehan being arrested at the U.N. It’s here at Truthout, I guess she got kind of roughed up too getting to jail. The video makes me cry because they are only speaking truth and speaking their opinions as Americans and along the way of course are guys in long wool coats trying to prevent them from getting into the U.N. and other such things. I know she travels with attorneys and they know just about exactly what they are getting into and what to challenge. Makes me cry though that American citizens have to travel with attorneys to be able to protect their rights against these goons!

In addition to their effort to paint Feingold as an unscrupulous partisan opportunist, Blitzer also has introduced their Claude Allen story several times by saying it was a complete surprise to the White House and everyone else. Yeah Wolf, how could they have seen this coming when Allen resigned more than a month ago to “spend more time with his family”? Oh wait, it could be because Allen told them about it in early January when he tried to pretend it was a mistake.
I’m not sure why Wolf is spreading this spin that the people in the White House are oblivious morons, but it works for me.
And Blitzer just introduced Cafferty by saying that Jack was someone who was always in the Situation Room, to which Cafferty immediately quipped “like a prisoner”. I don’t think Cafferty has a high opinion of his pro-Republican spinning comworkers right now.
CNN is complete damage control right now. I read in a reputable source somewhere recently of how much flack KO gets from his MSNBC bosses for being critical of the admin. It doesn’t seem to do any good. I even sent emails to Olbermann back during the 2004 debates when his round by round live blogging seemed to bend over backwards to keep the fight even. He isn’t perfect, he just looks miles better compared to every other talking head on cable news.
Several anchors on CNN Headline News have introduced the censure this morning by saying that many democrats oppose it, without naming any. Then they immediately cut to a clip of Cheney speaking yesterday. While I have no doubt that many spineless dems are opposed for various opportunistic reasons, it would be nice if a news outlet would name some of them so we can express our outrage over the phone and through email. I’m sick of politicians pretending they haven’t taken an opinion yet.
But I just saw an excerpt from Bush’s latest wishcasting and he announced proudly that we have established an “IED Joint Center of Excellence”.
Excellence? Do soldiers get gold stars for attending? Why does this give me the impression that they aren’t taking this grave problem seriously? I swear to God, the White House never seems to care about actually solving problems as long as the media and public can be convinced that the problems have already been solved. You would think they might realize this strategy isn’t working anymore from all of the incompetent bumbling that has bitten them in the ass lately, but no, I guess not. Appearance over reality in all things.

SAO PAULO, Brazil (Reuters) – A Lebanese woman suspected of involvement in the assassination of former Lebanese Prime Minister Rafik Hariri has been arrested in the Brazilian city of Sao Paulo, police said today.
Rana Abdel Rahim Koleilat, 39, who was sought by the international police agency Interpol, was arrested at a hotel in the city on Sunday afternoon by police acting on a tip.
