As I discussed on Monday, it’s curious that Rand Paul’s neighbor is only being charged with fourth-degree assuault, a misdemeanor. Keep in mind that according to reports, this man charged across Rand Paul’s lawn and attacked him from behind. Sen. Paul, who allegedly had just disembarked from his riding mower, suffered six broken ribs, three of them displaced, and a pleural effusion resulting from a lacerated lung.
His assailant has offered no explanation for his behavior, although his lawyer has stated that most of us would consider the altercation to have arisen from a trivial matter unrelated to politics. Appearing in court today, Rene Boucher, a retired anesthesiologist, pleaded not guilty. And that’s a bit curious, too, because assaulting a member of Congress is a federal crime on a good day, and caving in one side of a senator’s chest is hardly a trivial matter. The Warren County Attorney, Amy Milliken, was questioned about the light charges on the courthouse steps, and she said “both the FBI and the Kentucky state police are continuing their investigation,” and that given the severity of Sen. Paul’s injuries, additional charges could be added. Why not plead guilty while the charges are still a slap on the wrist?
Now, initially Rand Paul minimized the extent of both what happened (an “unfortunate incident”) and the extent of his injuries. The police report says Paul explained that he was merely “tackled him from behind, forcing him to the ground and causing pain.” Then the New York Times reported that it arose out of a landscaping dispute.
I had my doubts.

Today, Breitbart is pushing an angle to the story in which they’re at great pains to talk about what an amazing neighbor and citizen Rand Paul is but in which they’re also quoting neighbors to debunk the idea that “some sort of plant or flora issue” was the cause of the attack. Rand Paul has endorsed the Breitbart angle by retweeting links to it, but he hasn’t otherwise made any comment.
Insofar as the senator has made any comment about motive, he’s said that he isn’t really sure why he had his ribs caved in by his neighbor. If it were me, and I didn’t know, I’d be wanting to know. And I’d also be calling for a stronger punishment than a misdemeanor charge that comes with a $7,500 fine. Rand Paul could have died from injuries that severe, especially if one of three jagged displaced ribs had severed an artery. As it is, he’ll probably find it hard to breath for weeks and won’t be fully recovered for half a year or more, if ever.
So, why does he seem so disinterested in learning the reason he was attacked? Why isn’t he calling for felony or federal charges? Why did he seem to downplay what happened when he talked to the police? If it wasn’t a landscaping dispute, what was it? And why does the assailant think he can beat the charges or that it’s in his best interests to plead not guilty?
My guess is that the senator doesn’t want people to know why he was attacked and that he was hoping that the matter could be quietly dropped. This is supported by reporting from the New York Times.
The three Kentucky Republicans, who requested anonymity to discuss the case, said Mr. Paul had been embarrassed by the incident and was not interested in drawing attention to it.
But since Mr. Boucher declined to take the generous offer of a misdemeanor charge for trespassing on a U.S. Senator’s lawn and caving in his chest, I guess this thing is going to head to trial and will draw a ton of attention.
What are the possible defenses for committing this kind of violent assault? If you’re an attorney, maybe you can tell me. I can think of some mitigating factors like crimes of passion. But other than some kind of insanity defense, I don’t know of any way you can win an acquittal for the kind of crime that Boucher committed in this case unless it was so obviously justified that the jury basically nullifies the charges. I’m thinking something along the lines of child molestation. Yet, neighbors told the Times that Boucher lives alone.
I don’t know if we’ll ever find out what the motive was, and I suspect Rand Paul wants it that way. Everything he’s said and done has indicated that he’s more interested in having the matter dropped than in getting justice for himself.
And that’s just making everyone really curious. If this thing remains a misdemeanor, it will really be stunning. On the other hand, if the charges are dropped entirely, I won’t be shocked. I doubt very much that Rand Paul wants Mr. Boucher explaining himself in court.

White guy privilege on steroids. If a black man had tackled him and injured him, no matter the reason, this would be a huge deal and Paul would be screaming for justice.
Assumes facts not in evidence. There’s no doubt Rand’s father is a vicious racist, as evidenced by his newsletter. I don’t know that there’s any such background for Rand. There may well be, but he hasn’t been nearly so blatant about it as his father was. I do think the DA would be less willing to go along with Rand’s request to keep things quiet.
I’d think multiple rib fractures would overpower any tendency a racist had to give forbearance to a fellow white guy, but what do I know?
a commentor at TPM, Plucky in KY said would find out the facts; today has a comment stating RP is growing pumpkins into Boucher’s land, also has an odiferous compost heap on the boundary of the property. Dude would have to be insane to attack a U.S. Senator over pumpkins and compost, and doubly so to plead not guilty. And is that really so embarrassing that Paul would not want anyone to know?

They needed a fence. Guess Paul felt a fence limited his liberty/freedom.
Maybe the Homeowners’ Association prohibits fences? I look forward to somebody digging this out. The not guilty plea is mind-boggling. There must be some reason Boucher is certain Paul will intervene with the DA to have all charges dropped.
It doesn’t make any sense. Someone grows something on your land, you plow it up, right as they watch if you can. That’s what I did. The fence was four feet on my side of the line, they loudly insisted they wanted it there, I went and got my sawzall and cut the fence over while they watched. It’s been 15 years, and they have been the politest neighbors imaginable. It was a teachable moment.

All he had to do was bring in a master composter to fix the problem. Composting, done correctly, does not smell bad.

Actually, when it comes to a pumpkin patch planted on your land by Rand Paul, Aqua-Budda Libertarian Extraordinaire, of which that movement holds private property rights in the highest esteem, then a righteous beating might be called for in this blatant case of hypocritical trespass.
Well, if the assailant were a fellow Merkin then perhaps he was screaming “I’m standing my ground! I’m standing my ground” while attacking the Senator. That worked for one white guy who shot his neighbor – while standing in his neighbor’s yard!
Maybe there’s something hiding in the woodshed, but maybe Paul just finds the whole thing embarrassing and stupid.
As in, the two had an argument which got heated, and then someone got physical. Paul ends up on the turf with broken ribs. Over some stupid plants and/or compost.
I cannot imagine how that must hurt. I’ve cracked a rib here and there, and to say it causes discomfort is an understatement.
And Paul better be damn careful, because I can guarantee his doctor has prescribed opioids for the pain.

I’m curious about the timing of the Roy Moore story. Maybe the WaPo just figured this out on their own, or maybe someone led them to this story. Who? I would guess R instead of D…trying to get him to drop out. Though it seems like he is inclined to stay anyway.
Although…if I were the republicans, I would let this break after he was elected. Then expel him, and get a pliable R-appointed senator.

I’m an attorney. Though the law differs from state to state, I’d be really surprised if there were a “crimes of passion” defense. Perhaps if this were 1917 but not today. Insanity defenses have been narrowed and narrowed to the point where they almost don’t exist.
I’ve no idea what Paul is wanting to hide. Clearly his neighbor is telling him to suck it. My guess is the charge is somehow dismissed without this ever seeing the light of day, though people will keep sniffing around.
Let’s see.

You’re right it makes no sense. Even the “Paul did something horrible to provoke it” makes no sense. Why contest the charge and then send your lawyer out to call the provocation a trivial matter? Insanity defense? Why doesn’t the lawyer start laying a foundation for that then?
…other than hiding the top of his bald head with varmint poontang, and hiding his youthful water-cooled smoking indiscretions, and hiding his well-documented racist past going back a generation of Pauls…probably just tip of the varmint iceberg. ‘weasely’ is the word that comes to mind. >> board certify this discovery phase MF’er !!
Did Boucher have any injuries?
From a “traditional male ego” POV, another aspect of this is that Boucher appears to have completely kicked Paul’s ass with Paul putting up no effective defense.
If you are a man with a lot of ego tied up in your manliness, and you just got your ass kicked to the point of breaking multiple ribs and lacerating your lung, then you will probably want to do two things:
The fact that he got his ass kicked by a Dem is no doubt an extra sting.
Rand Paul did something immoral and/or illegal.
There is NO WAY that someone, who beats the shyt out of an United States Senator winds up with misdemeanor charges, unless said Senator has done something that he is desperate to not have revealed.
